LEASING A HORSE OR A HORSE OUT ON TRIAL

The question has been raised by some of my readers about how to handle the insurance coverage for a leased horse or your OWN horse out on trial for sale.

In the first instance, it is similar to leasing a car. You must insure the horse as if it was your own and include the owner as Additional Insured and Loss Payee in the event of a claim. The amount of insurance is determined by the lease requirements and it would include full mortality and probably loss of use, surgical and/or major medical. This protects the interests of the owner and the lessee.

It is slightly different when a horse is out on trial for sale. It may be going to an individual person or an agent for sale. In either case one would make sure that there is mortality for the value of the horse, loss of use and/or the surgical or major medical coverages. In addition, it is important to have personal liability. If your horse causes injury or property damage while out on trial to a person or location unknown to you, you COULD be responsible for damages caused. The ultimate responsibility rests with the OWNER of the horse. The owner, along with the agent who arranges the trial for sale, could be up against legal actions. The legal entanglements are best left in the hands of the Insurance Carriers and the attorneys. It is safe to say that the slight cost of these coverages is not as important as the blanket of protection they afford.
